Terms of Use
Effective date: 2026-05-19 · Operator: Robustresults Pvt Ltd (parent company of EvalAssist AI). Governing law: India.
1. Acceptance
By accessing or using EvalAssist AI (the "Service") — whether via the web app, mobile shim, API, or any integration — you agree to be bound by these Terms of Use. If you do not agree, do not use the Service. For users under 18, the agreement is held by the parent/guardian or the school under whose account the user accesses the Service.
2. Definitions
- "Operator" — Robustresults Pvt Ltd, the legal entity providing the Service.
- "User" — any student, teacher, parent, school administrator, principal, or coordinator with an EvalAssist account.
- "School" — an institution that has signed a Master Services Agreement with the Operator and onboards Users under its tenancy.
- "Content" — question papers, answer sheets, marking schemes, student work, teacher annotations, and any other data uploaded to or generated by the Service.
- "Evaluation" — the AI-assisted scoring, feedback, and report output produced by the Service for a given submission.
3. Accounts & access
Users must provide accurate registration information and keep their credentials confidential. Schools are responsible for managing their teachers' and students' accounts under the School's tenancy. Sharing accounts, automated login, or circumvention of role-based access controls is prohibited.
The Operator may suspend or terminate accounts that breach these Terms, that show signs of compromise, or upon written request of the School.
4. Content ownership & licence
Schools, teachers, and students retain all rights, title, and interest in Content they upload. By uploading, the User grants the Operator a limited, non-exclusive, royalty-free licence to process the Content solely to deliver the Evaluation, dashboards, reports, and audit trail that the User or their School has requested, and to operate the Service.
The Operator does not claim ownership of student work, teacher annotations, or School marking schemes, and will not use Content to train third-party models without the explicit written consent of the School.
5. Evaluation accuracy & human review
Evaluations are produced by the in-house SARAS evaluation model (an internal model developed and operated by Team Prachin under the Operator) with a vetted backup tier for low-confidence cases. The Service is designed as an assistive tool for qualified teachers, not as a replacement for human grading.
Predicted grades, percentages, integrity flags, and improvement plans are indicative. A qualified teacher must review and confirm any Evaluation before it is treated as official, communicated to parents, or used as a basis for promotion, retention, college applications, or any other consequential decision.
Confidence bands and integrity flags are surfaced on every Evaluation. Users are required to honour them.
6. Prohibited use
- Reverse engineering, decompiling, or attempting to extract the SARAS model weights, prompts, or proprietary scoring logic.
- Automated scraping of the Service or its outputs, beyond what is permitted by your School's API integration agreement.
- Uploading content the User does not have the right to process (copyrighted material, third-party student work without consent, etc.).
- Using the Service to harass students, manipulate grades for non-academic reasons, or generate work to be passed off as the student's own.
- Sharing School- or student-tenancy data outside the authorised role-based access (student data is bound to the School's tenancy).
- Probing, scanning, or testing the vulnerability of the Service without prior written authorisation from the Operator.
7. Operator intellectual property
The SARAS evaluation model, source code, design, rubric library, marking-scheme database, knowledge tree, board-pattern templates, brand, and all related intellectual property are owned by the Operator. Use of the Service grants no transfer of ownership in any of these. The Operator's logos and trademarks may not be used without prior written consent.
8. Service availability & modifications
The Operator targets 99.0% monthly uptime but does not guarantee uninterrupted access. Scheduled maintenance is notified in advance to School administrators. Features may be added, modified, or retired with reasonable notice. Material changes to functionality affecting Schools are notified at least 30 days before they take effect.
9. Disclaimers
The Service is provided "as is". To the maximum extent permitted by applicable law, the Operator disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
The Operator is not liable for educational outcomes, college admissions, scholarship decisions, or career consequences flowing from use of the Service. The Service supplements — it does not replace — the professional judgement of a teacher.
10. Limitation of liability
To the extent permitted by law, the Operator's total cumulative liability for any claim arising out of or related to the Service is limited to the fees actually paid by the claiming School to the Operator in the twelve months preceding the claim. For Users on the free plan, total liability is capped at INR 5,000.
11. Indemnity
Users (or Schools, for their User base) agree to indemnify the Operator against any third-party claim arising from (a) Content they uploaded without proper rights, (b) breach of these Terms, or (c) misuse of the Service or its outputs.
12. Data protection
Processing of personal data is governed by the EvalAssist AI Privacy & Data Protection summary and, for Schools, by the signed Data Processing Agreement (DPA). The Service complies with the Indian Digital Personal Data Protection Act 2023 (DPDP) and, for international Schools, the GDPR children's-data alignment matrix available on request.
13. Termination
Schools may terminate their subscription per the Master Services Agreement. Individual Users may delete their account at any time
via /v2/profile → Delete my account, exercising their DPDP §13 right-to-erasure. On termination, the Operator
will anonymise (not retain) personally identifiable evaluation history, except where retention is required by law or by an active audit hold.
14. Governing law & dispute resolution
These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of New Delhi. Before initiating litigation, parties agree to attempt good-faith resolution and, if unresolved within 30 days, mediation under the Arbitration and Conciliation Act, 1996.
15. Changes to these Terms
The Operator may update these Terms from time to time. Material changes are notified to School administrators by email and posted on this page with a revised effective date. Continued use of the Service after the effective date constitutes acceptance.
